Terms of Use
The short version
- Your songs are yours. I don’t own them and I can’t see them.
- Genesis is licensed to you under Apple’s Standard EULA. These terms add the details.
- Genesis Pro renews automatically until you cancel in Settings › Apple Account › Subscriptions, at least 24 hours before it renews.
- Purchases and refunds are handled by Apple.
- Keep a backup of songs that matter to you.
These Terms of Use (“Terms”) cover the Genesis app and this website, made by Gustavo Zegarra (“I”, “me”). By downloading or using Genesis, you agree to them. If you don’t agree, please don’t use Genesis.
1. Your license to use Genesis
Genesis is licensed, not sold, to you. Your license is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to the Standard EULA. If anything here conflicts with it, the Standard EULA applies.
2. Genesis Pro subscriptions
Genesis is free to download, and its free features are free to use. Genesis Pro is an optional auto-renewable subscription that unlocks more features, described on the Free and Pro section of this site and in the app.
- Plans. Genesis Pro Yearly ($49.99 a year in the US, with a 7-day free trial) and Genesis Pro Monthly ($7.99 a month in the US). The app shows the exact price in your currency before you buy.
- Payment. Payment is charged to your Apple Account when you confirm the purchase. If you start a free trial, you’re charged when the trial ends, unless you cancel before then.
- Automatic renewal. Your subscription renews automatically for the same length and at the same price unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- Managing and canceling. You can manage or cancel your subscription any time in Settings › Apple Account › Subscriptions on your iPhone. When you cancel, you keep Genesis Pro until the end of the period you’ve paid for.
- Free trial. The 7-day free trial is for new subscribers to the yearly plan, once per Apple Account. If you cancel during the trial, you won’t be charged. Any unused part of a free trial ends when you buy a subscription.
- Prices. Prices vary by country or region and may include tax. If a price ever goes up, Apple will tell you in advance and, where required, ask you to agree before you’re charged the new price. $49.99 a year is a launch price: if you subscribe at that price, you keep it for as long as your subscription stays active.
- Refunds. Purchases are made through the App Store, so refunds are handled by Apple under its policies. You can ask Apple for a refund at reportaproblem.apple.com. I can’t issue refunds myself.
- Restoring. Use Restore Purchases in the app to get Genesis Pro back on a new iPhone signed in to the same Apple Account.
- When Pro ends. Nothing you made is taken away. Your recordings still play and export, and processing you already added is still heard. Adding past the free limits and changing Pro settings need Pro again.
3. Your songs
Everything you write, record or make in Genesis (your “content”) belongs to you. I don’t claim any rights to it, and Genesis doesn’t upload it. Chord suggestions, progressions and rhymes in Genesis are common musical building blocks, and you’re free to use them in your songs.
Your content is stored on your iPhone. You’re responsible for keeping copies of songs that matter to you, for example with iCloud Backup or Export All Songs. I can’t recover songs that were lost from your device.
You’re responsible for having the rights to anything you bring into Genesis, such as recordings or lyrics written by other people.
4. Using Genesis fairly
Please don’t:
- copy, resell or redistribute the app or its built-in sounds, chord library or rhyme library as your own product;
- get around the subscription or other technical limits;
- reverse engineer the app, except where the law allows it;
- use Genesis to break the law or infringe anyone else’s rights.
5. Downloads and other services
Some features download files the first time you use them: the Live Lyrics speech model from Hugging Face, and the Grand Piano sound from Apple. These services are run by others, so I can’t promise they’ll always be available. Genesis includes open-source software under its own licenses, listed in Settings › Help & About › Acknowledgements.
6. Beta versions
Beta builds on TestFlight are unfinished and may have bugs, including bugs that lose data. Please keep a copy of anything important. Subscriptions bought in TestFlight are free test purchases and don’t carry over to the App Store version. Apple’s TestFlight terms also apply.
7. Changes to Genesis
I work on Genesis all the time, so features may be added, changed or removed. I intend to keep writing in Genesis free.
8. Disclaimer
Genesis is provided “as is” and “as available”. Features that listen or suggest, such as Live Lyrics, Key Finder, Tempo Finder, Stems and Smart Chords, make their best guess and can be wrong, so check what they produce. To the extent the law allows, I make no warranties beyond those in the Standard EULA, and I don’t promise that Genesis will be error-free or always available.
9. Limitation of liability
To the extent the law allows, I’m not liable for indirect, incidental, special or consequential damages, or for lost data, lost profits or lost content, arising from your use of Genesis. My total liability for any claim relating to Genesis is limited to the greater of what you paid for Genesis Pro in the 12 months before the claim, or US$50. Nothing in these Terms limits rights you have as a consumer that can’t be limited by contract.
10. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. Any dispute will be handled by the state or federal courts located in [COUNTY] County, North Carolina, unless the law where you live gives you the right to bring it there. If you live in the European Union or the United Kingdom, you keep the protection of the mandatory consumer laws of your country.
11. Changes to these Terms
If I change these Terms, I’ll update this page and the date at the top. If a change is significant, I’ll also mention it in the app’s release notes. Continuing to use Genesis after a change means you accept the new Terms.
